The monograph is the result of a comprehensive system research, theoretical and practical understanding of constitutional conflictology as a new section of scientific knowledge about constitutional legal conflicts and ways to prevent them and resolution. The work presents the conflictological paradigm of the Russian constitutional and partly municipal law. The conflictological essence of the Constitution, the legal nature of the constitutional and legal conflict has been analyzed, its classification has been carried out, the concept and signs, criteria for other types of conflicting relationships are formulated, a structural characteristic is presented, the constitutional and municipal norms of the conflictological type were considered, their classification was carried out.
Considerable attention is paid to the methods of preventing and resolving constitutional and legal conflicts, legal risks of their occurrence and conflictogenes. The author proposed an algorithm for finding the optimal way to resolve constitutional legal conflicts. The monograph reflects the law enforcement practice of the Russian Federation and foreign countries on the prevention and resolution of specific constitutional legal conflicts.
All this allowed the author to formulate proposals for improving the legislation and the practice of resolving constitutional legal conflicts in the Russian Federation.
