In the reader’s attention, the book using the methodology of comparative law illuminates the actual and discussion problems of the implementation of patent legal relations in national and supranational law. The prospects of patent integration in the EU and the EAEU, harmonization and rapprochement of national legislation on patent law are considered. The author’s attention was focused not so much on the differences in the approaches of individual jurisdictions in the regulation of the affiliation and turnover of industrial property, but on the common problems of the implementation and protection of exclusive patent rights.
The study emphasizes the means of overcoming abuse of patent rights, special regimes for restricting exclusive rights, licensing, and the ratio of intellectual and competitive law regulation subjects. The dynamics of the expansion of patent protection objects, intersectoral problems of legal regulation of official inventions and the administration of registration of exclusive rights in public registers are analyzed. The relationship of the economic principle and priorities of legal regulation of patent legal relations is indicated.
