It is difficult to deny the usefulness of the method of comparative law. The study of foreign experience allows you to deeper into understanding the object of study and, accordingly, approach the solution of a particular scientific problem, including taking into account the latest doctrinal approaches. However, do we realize how correctly this method is used by us in reality? Do we see the grounds for the conclusion that the submitted foreign experience and the conclusions made on its basis can claim the status of scientifically based, and not descriptive knowledge?
The book presented to readers is the interpretation and criticism of the construction of comparative legal studies from famous and respected scientists and directors of the Institute of International and International Criminal Law Max Planck (Freiburg, Germany) On the example of the analysis of the functions, methods and theoretical concepts of comparative criminal law, attention is drawn to the negative aspects of the superficial attitude to the method. Close attention is paid to those criteria, on the basis of which we can confidently talk about the scientificity of the acquired comparative legal knowledge.
For scientists and practicing lawyers, teachers, graduate students, students, as well as a wide range of readers interested in comparative law
