This publication is a postal commentary on the Federal Law of December 30, 2004 No. 214-ФЗ “On participation in shared construction of apartment buildings and other real estate objects and on amendments to some legislative acts of the Russian Federation”. This work was prepared taking into account the amendments made by federal laws of July 29, 2017 No. 267-ФЗ “On Amendments to Certain Legislative Acts of the Russian Federation” and dated July 29, 2017 No. 218-ФЗ “On the Public Legal Protection Company for Protection for Protection the rights of citizens - participants in shared construction in the insolvency (bankruptcy) of developers and on amendments to certain legislative acts of the Russian Federation. ” Since October 20, 2017, a public legal company Fund for Protection of the Rights of Citizens-Participants in shared construction was created. This book also considers legal problems associated with the implementation of a comprehensive and large -scale program of the housing fund in the city of Moscow. The legal regime of a specialized non-profit organization- the Moscow Renovation Fund for residential development is analyzed. The law on the status of the capital provides for the payment of equivalent compensation in monetary form, both for residential premises and for non -residential premises in apartment buildings included in the decision on renovation. In addition, the law on the status of the capital provides for the seizure for state needs of premises in apartment buildings included in the decision on renovation owned by legal entities. Given the above novels, the most significant concepts and provisions are analyzed in detail, the judicial practice of applying the law is considered. The laws of legislation were used as of December 30, 2017. All references to regulatory legal acts are submitted to the last current version of the documents, with the exception of especially stipulated cases when the amendments and additions are commented.
