The procedure for civil proceedings in the federal courts of general jurisdiction is determined by the Constitution of the Russian Federation, the Federal Constitutional Law “On the Judicial System of the Russian Federation”, this Code and other federal laws adopted in accordance with them, the procedure for civil proceedings among the justice of the peace - also federal law “On Justices of Justice” In Russian federation.
If other rules of civil proceedings are established by the international treaty of the Russian Federation, than those stipulated by law, the rules of the international treaty apply.
Civil proceedings are carried out in accordance with federal laws acting during the consideration and permission of civil case, the implementation of certain procedural actions or the execution of court decisions (court orders, court rulings, decisions of the Presidium of the supervisory court), and decisions of other bodies) .
In the absence of the norm of procedural law governing the relationship that arose during civil proceedings, the federal courts of general jurisdiction and the justice of the peace apply the norm governing similar relations (analogy of the law), and in the absence of such a norm, they act on the basis of the principles of justice of justice in Russian Federation.
