Abuse of right by subjects of insolvency (bankruptcy) proceedings. Monograph

The monograph presents the result of a systemic study of the abuse of rights by participants in the relations of insolvency (bankruptcy), the author’s position is stated regarding the concept and signs of abuse of rights, its specifics in the relations of insolvency, prerequisites, causes, conditions, means and forms of abuse of rights by participants in bankruptcy. The author formulated the concept and the types of measures to counteract abuse of rights in bankruptcy were identified, and methods of protection against abuse of rights were analyzed. Based on the results of the study, changes in bankruptcy legislation are proposed.
Conclusions and proposals formulated in the work can be used as practical recommendations for legislators, judges and lawyers. The monograph can also be useful to students and graduate students, legal teachers of legal orientation universities
