The monograph is devoted to a significant legal practice in world legal practice, but notorious in Russian jurisprudence, a judicial activity - judicial doctrines gradually receiving attention in domestic discourse, taking into account the issues of judicial protection of subjective rights, the methodology of judicial interpretation, and judicial forms of development of law. The relevance of the work is determined by the need to study judicial lawsuits as a “binder functional link” between a common (abstract) order and a separate (specific) case subject to legal decision, which allows to effectively respond to legal problems through judicial argumentation and evaluation.
The work sets out the ideas of prominent domestic and foreign scientists, representatives of the judicial community about the judicial doctrine as the idea, concept, and the phenomenon of legal life, taking into account general trends in the development of theoretical thought and practice of law enforcement.
