The idea of creating a database of judicial acts of the Constitutional Court of the Russian Federation on issues of criminal proceedings arose three years ago with the authors. Primarily, it was seen as a support tool in the daily activities of defense attorneys. Drafting motions and complaints in criminal cases usually required referring not only to legislative norms but also to materials of judicial practice, especially the acts of the Constitutional Court of the Russian Federation.
The significance of the acts of the Constitutional Court of the Russian Federation for criminal proceedings is more substantial than for other procedural branches - civil, arbitration, and administrative - due to the presence of extensive pre-trial procedures. Given that there are very few legal positions from the Supreme Court of the Russian Federation on issues of preliminary investigation, the Constitutional Court of the Russian Federation with its extensive explanatory practice naturally came to the forefront.
These reflections predetermined the beginning of a large-scale activity to systematize the legal positions of the Constitutional Court of the Russian Federation. For convenience, judicial acts were refined - down to the subject of appeal and legal position - and placed in a tabular form with differentiation into sections that correlate with the structure of the current Criminal Procedure Code of the Russian Federation.
The book will be of interest to judges, prosecutors, investigators, interrogators, defense attorneys, employees, and students of legal educational institutions.
