In the monograph, the author explores the conflict of jurisdictions arising from challenging the arbitration agreement. The main material for legal analysis was the works of foreign scientists, English judicial precedents and the right of the European Union. Special attention was paid to the scientific discussion about the nature of the jurisdiction of state courts and the competence of the Arbitration Tribunal, English judicial practice on issuing judicial prohibitive orders to support the arbitration proceedings and reform of European law regarding the interaction of arbitration and state courts.
