The central topic of the book refers to "Eternal issues" philosophy and theory of law - the ratio of law and morality.
prof. R.Aleksi, exploring legal positivism, challenges the requirement to exclude the elements of morality in determining the right. On bright examples, the author shows not only the theoretical, but also the great practical importance of the correct answer to the question. After all, in the end, we are talking about whether an extremely unfair right is right in general and, therefore, whether it needs to obey and whether it can serve as an excuse for violation of human rights.
prof. R.Alexi criticizes legal positivism and gives convincing arguments in favor of such a definition of the right, which would include the elements of morality. Comparing the various concepts of law, the author offers the original concept of law that meets modern challenges in the context of increasing globalization.
