The book provides a postroom comment to the federal law of December 29, 2015 No. 382-FZ On Arbitration (Arbitration Procedure) in the Russian Federation. The procedure for the formation and activities of arbitration courts and permanent arbitration institutions in Russia, as well as arbitration procedures (arbitration) are considered in detail. A comparative analysis with the norms of the predecessor - the Federal Law of July 24, 2002 No. 102-FZ On Arbitration Courts in the Russian Federation, as well as with the norms of the Law of the Russian Federation of July 7, 1993 No. 5338-1 On International Commercial Arbitration. Changes made to legislation are described in connection with the adoption of the commented law, in particular, changes in procedural legislation (APC RF and Code of Civil Procedure of the Russian Federation).
When considering the norms of the law, the provisions of international acts are used, including the UN Convention on Recognition and Enforcement of Foreign Arbitration Decisions of 1958, the Model Law of UNCITRAL On International Trade Arbitration, the Arbitration Rules of UNCITRAL, took into account the legal positions formed highest judicial bodies of Russia.
The publication is intended for the parties to arbitration and arbitration agreements, arbitrators (arbitration judges), judges of the arbitration courts and courts of general jurisdiction, as well as for students and teachers of higher and secondary educational institutions
