Legal regulation of transplantation in the Russian Federation. Scientific and practical guide

The publication is devoted to the legal regulation of transplantation as one of the most important medical technologies of our time. The formation of medicine of the future requires the study of issues related to what kind of legal norms and mechanisms to a greater extent ensure the balance of the interests of scientists, practicing doctors, patients, their families, state management structures. However, in the field of transplantation there is another area of ​​interests represented by two areas: 1) the area of ​​the rights of a living person - donor and 2) the area of ​​interests of persons, related and otherwise related to the dead person, whose organs and tissues are used for transplantation.
This publication allows you to form a holistic idea of ​​transplantation as a special sphere of legal regulation. The history of the formation of transplantation legislation in Russia and foreign countries is shown, the place of transplantation in the system of medical activity is determined, the principles and organizational foundations of transplantation in the Russian Federation are described, a detailed characteristic of the legal status of the donor, the rights and duties of the recipient, the problems of bioethics are affected. Appeal to issues related to the financial support of transplantation, administrative and legal mechanisms of regulation based on the analysis of legal norms and law enforcement practice made it possible not only to focus on the problems of legal regulation, but also to develop proposals for its commission.
