The basis of this study is scientific articles written by the author from 2001 to 2008 and published in the journal The Arbitration Court. The main attention is paid to the arbitration agreement, which is a prerequisite for the appeal of one of the parties to such a widely known method of resolving disputes as arbitration.
This study contains a commentary on certain provisions of legal norms devoted to the arbitration agreement and contained in various sources of law: Russian and foreign legislation on the arbitration court, international documents, including international conventions on international commercial arbitration. A special place is occupied by examples from the practice of internal arbitration courts and international commercial arbitrations, Russian and foreign judicial practice.
Since the peculiarity of the phenomenon under study lies in the fact that the role of a scientific doctrine is of paramount importance in resolving controversial issues, the text contains a brief description of the actual circumstances of some judicial cases with subsequent commentary. Without playing the role of leading precedents, as in the Anglo -Saxon system of law, the court cases given are an excellent illustration of certain theoretical approaches to understanding the legal nature of the arbitration agreement
